Today brought a double dose of bad news for Abercrombie & Fitch Co. (ANF). On top of disappointing earnings for the second quarter, the Associated Press reports that a London court has ordered the clothing chain to pay a disabled employee about $15,000 for injured feelings and wrongful dismissal.

The court turned down a discrimination claim that Abercrombie had disputed.

Riam Dean, a 22-year-old university student, had complained that her bosses would not let her wear a sweater to cover her prosthetic arm and tried to shift her off the shop floor. Dean's suit claimed that she was told she didn't fit in with the "look policy" at the chain's store on Savile Row in central LondoAbercrombie has run into trouble in the past for putting style first when hiring. Five years ago, it settled several employment discrimination suits in the U.S.

And the hits kept coming. This morning, abercrombie posted disappointing second-quarter earnings -- a net loss of $19.8 million, due to $24.4 million in charges from closing down the Ruehl chain.

The company's same-store sales down 30 percent, to $648.5 million, over the second quarter of 2008. Sales at the abercrombie and fitch stores were down 27 percent, and same-store sales at Hollister were down 31 percent. Back-to-school is turning into a glum time.

Put simply, there are no gallant, selfless or likeable characters in Abercombie�s first standalone novel � yet somehow, you find yourself rooting for many of them. The basic plot, as the title clearly suggests, is a classic quest for revenge, but it�s in the execution, with a gleeful disregard for the ever-growing body count, and in the flawed characters, that Abercrombie�s talent shines.

Riam Dean has a prosthetic arm that attaches at the elbow, and she typically wears a sweater to cover the prosthetic. While A&F employees are required to wear jeans and a polo shirt, she was given permission to wear a white cardigan while working on the floor. But only a few days after she started work, the store was paid a visit by the �visual team.� This group�s purpose is to sure the shop and its staff look up to code. One of the members of the team demanded she take off the cardigan, but she insisted she had permission to wear it. Nevertheless, she was asked by management to continue her employment in the stockroom, far out of the public eye. Management claimed that she �violated the �Look Policy,� which is an imperative part of working for such a prestigious clothing outlet. As if she could help the fact that she is, unfortunately, missing an arm. Totally her fault, I suppose. The nerve. Pssh.

A&F has never been a stranger to discrimination suits; one was recently settled in the US for discrimination during the hiring process in that they would allegedly only hire �young and beautiful� men and women to work in their stores.

Abercrombie and Fitch recently announced it will pull the plug on its RUEHL chain, a concept with 29 stores in high-profile malls across the country that targeted well-heeled consumers in their 20s. Abercrombie blamed �the severe economic downturn� for sinking the stores, which launched in 2004, generating an operating loss of $58 million during the company�s prior fiscal year.

But maybe it�s not just the economy�s fault in this case. REUHL is just another example long line of concepts rolled out by established chains over the last few years that were either closed or abandoned. The lesson here is that some of these retailers might be better off sticking to their core concepts instead of pushing ever more demographic-specific options out to the consumer.

Shivers is the only character in Best Served Cold making a conscious effort to be a better person. The trouble, as he discovers, is that death follows Monza Murcatto around like a faithful companion � and one revenge scheme after another comes to define the word �overkill�. Along the way, there are plenty of double-crosses and revelations that give us opportunities to re-evaluate our initial impressions of the characters, not least Monza�s deceased brother, and the action shifts from one city to another, all in the midst of the ongoing civil war in which Monza made her name as a mercenary.

Best Served Cold exhibits abercrombie's trademark black humour in spades, and the standalone novel form provides him with ample opportunity to show off his plotting skills � but don�t let the glibness fool you, the author and his characters do recognise the terrible nature of the violence being described, and don�t try to downplay the human cost. It�s a testament to Abercrombie�s skill as a storyteller that he can, over the course of your acquaintance with them, make you care about generals, assassins, cut-throats, barbarians, poisoners and (worst of all?) politicians so much, and in spite of their dubious deeds. Best Served cold is definitely this author�s best work to date, and I would be very happy to see him continue in this vein when he returns to the wonderful world he has created.

Today we found out just how hard one-time retail star Abercrombie & Fitch (ANF) got hit by the negative confluence of events over the past three months. The much-steeper-than-expected quarterly loss looks horrible when compared to the profit of $77.8 million the company posted in the same quarter a year ago.

But like so many topsy-turvy things on Wall Street these days, the shares gapped up in early trade as investors focused on the company�s valiant cost-cutting efforts, which included the closure of its Ruehl brand stores.

Now there is no denying that abercrombie and fitch has been a victim of the push toward a new frugality in America. The best measure of this is that the all-important same-store sales metric fell 30% over the past three months. But what we�ve also seen in the case of Abercrombie is a bit of a backlash against the company�s self-portrayal.

Last fall the ChangeWave Alliance Research Network conducted a survey that focused on consumer retail buying habits. Respondents were asked which retail stores they were least likely to shop at, and why.

At the top of the list was Abercrombie. Now, it wasn�t the company�s high prices relative to lower-cost alternatives such as Aeropostale (ARO) and American Eagle Outfitters (AEO) that caused consumers to roil at the prospect of patronage. The problem was, as one respondent wrote, the �immoral advertising and the message it sends to teens.�

Other respondents wrote in to take the company to task for its overly suggestive catalog, its lack of moral values and what was perceived to be an over-sexualized image. One respondent put it succinctly by saying they objected toabercrombie �nasty advertising.�

Yes, the recession has hit nearly all retailers hard. But when you combine a general reluctance of consumers to spend money; a further hesitance to spend that money on high-priced items during a recession, and a moral aversion to products with a risqu� image, you have a trifecta of reasons why it�s likely to be a tough slog ahead for ANF.

HONOLULU -- The state Campaign Spending Commission members ruled against U.S. Rep. Neil Abercrombie transferring funds from his Congressional campaign to his campaign for governor.

The commission sided with the attorney for Mayor Mufi Hannemann's campaign committee and an attorney for the Hawaii Republican Party. Both fought to block abercrombie and fitch from transferring his federal campaign money to his state gubernatorial run.

The commissioner ruled 4-0 with one abstention. The one commissioner abstained because his law firm represents a candidate running for office.

Abercrombie's attorney Karl Sandstrom argued that state and federal law does not rule directly against a candidate transferring funds from a federal campaign to a state campaign. The commission is making up laws, Sandstrom said.

"We are disappointed with the decision because we believe state law does not expressly prohibit transfer of federal surplus funds to state campaigns," Sandstrom said. "All candidates should be treated equally, and the commission should not sanction double standards."

Abercrombie wanted to move $900,000 from his federal campaign to his run for governor. Without the transfer it would leave abercrombie with about $400,000 in his war chest.

"I think the law is pretty clear that the federal funds don't fit into our state scheme. The state has its own comprehensive law, which really governs what funds can be contributed and what can be spent in a state campaign," Smith said.

The commission has said that Hannemann can transfer funds from his mayoral campaign to his campaign for governor because the money remains within the state.

Hannemann has $1.2 million in his campaign for governor.

Sandstrom said they are considering an appeal, but they have not made a decision yet.

NEW YORK � Teen apparel retailer Abercrombie & Fitch Co. reports earnings for the fiscal second-quarter quarter on Friday. The following is a summary of key developments and analyst opinion related to the period.

OVERVIEW: abercrombie and fitch. has seen sinking sales amid the recession, as it kept its price points among the highest in the teen sector and waited for a rebound. Over the past few months it has planned more sales and offered lower entry-level prices, but sales are still expected to sink during the quarter ended Aug. 2. Meanwhile, competitors such as Aeropostale Inc. and American Eagle Outfitters Inc., with their emphasis on low prices and basics, have fared better.

Sales in stores open at least on year, or so-called same-store sales, fell 28 percent in July, 32 percent in June and 28 percent in May.

The company said it was shuttering its high-priced Ruehl line of handbags and apparel in a move expected to be complete in January 2010. New Albany, Ohio-based

BY THE NUMBERS: Analysts polled by Thomson Reuters, on average, predict a loss of 7 cents per share on revenue of $647.9 million. The company said, according to a preliminary tally, sales fell 23 percent to $648.5 during the quarter.

ANALYST TAKE: In a note to investors, RBC Capital Markets analyst Howard Tubin said in a client note Tuesday lowering price points and offering more "current-season" fashion in stores are encouraging acts, but he said it will take more of an effort for results to improve.

"We remain on the sidelines with respect to the shares until we see significant newness offered within the assortments across all concepts," wrote Tubin, who rates the company "Average Risk."

Stifel Nicolaus analyst Richard Jaffe wrote in a note to investors that he expects a loss of 3 cents per share, with weak women's apparel offerings and the recession holding back results.

"On a positive note we believe management has demonstrated better inventory management, which bodes well for the second half and we believe that the markdown cadence will likely be more effective going forward (shallower markdowns taken throughout the quarter instead of deep clearance activity at the end of the quarter)," he wrote.

WHATS AHEAD: Analysts will be looking for any indication about how back-to-school sales are doing, an update on closing Ruehl stores and any indications about how the company is planning for the upcoming holiday season.
